Welcome to Mobbi AI. These Terms and Conditions ("Terms") govern your access to and use of the Mobbi AI website at mobbi.ai and all related services, features, and content (collectively, the "Service") provided by Mobbi AI ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.

Mobbi AI is an AI-powered platform that enables users to create videos, images, and other multimedia content using artificial intelligence technologies. Our services include but are not limited to:

• AI video generation (text-to-video, image-to-video)
• AI image generation and editing
• Story Agent for automated video creation
• Video editing tools (lip sync, face swap, upscaling)
• Voice and music generation

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

To access certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old (or 16 in certain jurisdictions) to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4.1 Subscription Plans

We offer various subscription plans with different features and credit allocations. By subscribing to a paid plan, you agree to pay the applicable fees as described at the time of purchase.

4.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except as expressly stated in these Terms
• We use Stripe for payment processing; your payment information is subject to Stripe's terms and privacy policy
• You authorize us to charge your payment method for all fees incurred

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds will be provided for partial billing periods.

4.4 Price Changes

We reserve the right to change our prices at any time. Price changes will be communicated in advance and will apply to subsequent billing periods.

• Credits are used to generate content on the platform
• Subscription credits reset at each billing cycle and do not roll over
• Purchased credit packs (top-ups) do not expire
• Credits have no cash value and cannot be transferred or refunded
• We reserve the right to modify credit costs for features at any time

6.1 Your Content

You retain ownership of the content you upload to the Service (prompts, images, videos, etc.). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing the Service.

6.2 Generated Content

Subject to these Terms and applicable laws, you own the content generated through your use of the Service. You are responsible for ensuring your use of generated content complies with all applicable laws and does not infringe on third-party rights.

6.3 Content Restrictions

You agree not to upload, create, or generate content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains nudity, sexual content, or pornography
• Depicts violence, gore, or promotes harm to others
• Infringes on intellectual property rights of others
• Contains personal information of others without consent
• Impersonates real individuals without authorization
• Spreads misinformation or deceptive content
• Violates any applicable laws or regulations

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service without permission
• Reverse engineer or attempt to extract source code
• Resell, sublicense, or redistribute the Service
• Use the Service to compete with or replicate our offerings
• Circumvent any access or usage limits
• Share account credentials with others

The Service, including its original content, features, functionality, and underlying technology, is owned by Mobbi AI and is protected by copyright, trademark, and other intellectual property laws.

Our trademarks, logos, and service marks may not be used without our prior written consent. Nothing in these Terms grants you any right to use our branding or intellectual property.

The Service may integrate with or rely on third-party services, including AI model providers, payment processors, and cloud services. Your use of these services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or content of third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• The quality of generated content will meet your expectations
• Any errors in the Service will be corrected

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBBI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Mobbi AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or generate through the Service

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and associated data
• Any unused credits will be forfeited
• Provisions that by their nature should survive termination will survive

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mobbi AI operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits against us.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

We encourage you to review these Terms periodically for any updates.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mobbi AI regarding your use of the Service and supersede any prior agreements or understandings.
